Terms of Service

Attribution required for any public posting: “📸 Booker Photo” + tag @booker.photo (or “Booker Photo” on that platform).

Quick Summary (Plain English)

  • These Terms cover how you view, share, favorite, comment, proof, and (if enabled) download images in your Booker Photo galleries.

  • Default privacy: Galleries are unlisted and password‑protected. Visitors may be asked to enter an email to view. Downloads (when enabled) are PIN‑locked.

    • Attribution required for any public posting: “📸 Booker Photo” + tag @booker.photo (or “Booker Photo” on that platform).

  • Availability: Galleries stay online for 1 year (12 months). We may send service emails (e.g., delivery, reminders/expiry). Please download before expiry and keep backups.

  • This page is only about gallery use. Store Terms of Sale and Digital Image Licenses live separately in Pixieset.

Booker Photo – Client Gallery Terms of Service (Use & Sharing)

Effective date: September 18, 2025

These Terms govern your access to and use of Booker Photo client galleries hosted on Pixieset (the “Galleries”). By visiting a Gallery, favoriting, commenting, sharing links, or downloading files, you agree to these Terms. If you have a separate written agreement with Booker Photo (e.g., Photography Services Agreement or model release), that agreement controls where it conflicts with these Terms.

1) Who we are & contact

2) Access, privacy & account security

  • Private by default. Most galleries are unlisted and protected by a Collection Password. Treat the link/password like a key—share only with intended viewers.

  • Email registration. We may require visitors to provide an email address to view the Gallery. This helps us manage access and communicate service updates about the Gallery.

  • Your responsibility. You are responsible for activity under your link/password. Tell us promptly if access was shared in error and you want it reset.

  • Event exceptions. For certain events (e.g., weddings), the gallery may be listed on our index for easier discovery, but it may still be password‑protected.

3) Gallery availability & reminders

  • Unless stated otherwise in your booking email/contract, galleries remain online for 1 year (12 months) from delivery notice. After that, we may archive or remove them.

  • We recommend you download promptly (if downloading is enabled) and create your own backups. Archival is not guaranteed.

  • Service emails. We may send non‑marketing emails related to your Gallery (delivery notices, access changes, upcoming expiry, anniversary reminders). You can opt out of marketing emails separately.

4) Viewing, proofing & watermarks

  • Proofs vs finals. Some galleries are delivered as “proofs” for selection; these may include watermarks or lighter edits. Final delivered images may differ after retouching, cropping, or color adjustments.

  • No watermark removal. Do not remove or crop out watermarks. Please request finals or licensed downloads if you need clean files.

5) Downloads from the gallery (if enabled)

  • Scope. If download is enabled, you may download images for personal review/archiving within your household.

  • PIN & permissions. Downloads may be protected by a Download PIN. By default, the Collection Contact(primary client) has full‑resolution download permission; guests may be view‑only or limited to web‑size at our discretion or per the client’s request.

  • Not a license. A gallery download does not grant permission to publish, advertise, or use images beyond personal viewing unless your separate Digital Image License (in the Store or your contract) expressly allows it.

6) Sharing & social media (attribution required)

  • Sharing links with family/friends is fine. Avoid posting unrestricted public links if the gallery contains minors or private events.

  • Attribution required for public posts where your license allows social sharing:
    Credit: “Photo by Booker Photo” or "📸 Booker Photo"
    Tag: @booker.photo (Instagram) or “Booker Photo” on the platform’s tagging system.

  • No posting of proofs or watermarked images publicly without written permission.

  • No resale or redistribution. Do not upload images to stock sites, resale platforms, AI training portals, or public datasets.

7) Minors & sensitive content

  • Parents/guardians control sharing for minors. Please be mindful about posting images that reveal school, addresses, or routines.

  • If you see an image of a minor you want hidden or removed from public visibility, email us with the gallery link and image numbers; we’ll review promptly.

8) Technology, cookies & limited AI use

  • Platform. Galleries run on Pixieset. Pixieset and embedded services may use cookies/analytics per their policies.

  • Internal tools only. We may use limited automated tools (e.g., duplicate detection, similarity grouping) to curate galleries. We do not sell biometric data or build/transfer facial recognition databases, and we do not permit third parties to train AI on client galleries.

  • You may not use images from the Galleries to train AI models, perform facial recognition, or create deepfakes/derivatives.

9) Intellectual property & permitted uses

  • All images are the intellectual property of Booker Photo and/or the photographer. No ownership transfers to you via gallery access.

  • Your permitted uses are limited to viewing, favoriting, commenting, proofing, and (if enabled) personal archiving. Any broader use (printing, publication, commercial use, brand use, advertising, etc.) requires a separate written license or purchase in the Store.

10) Prohibited conduct

You agree not to:

  • Bypass security or share restricted content publicly without permission;

  • Remove or alter watermarks or copyright notices;

  • Bulk‑download or scrape images, metadata, or emails using bots or scripts;

  • Upload unlawful content, malware, or infringing material in comments;

  • Use images to harass, defame, mislead, or imply endorsement without permission;

  • Post screenshots of watermarked proofs publicly;

  • Use gallery content for AI training, biometric analysis, or similar purposes.

11) Takedowns (copyright/privacy)

If you believe a gallery contains content infringing your rights or creating an undue privacy risk, contact memories@booker.photo with: (1) your contact info, (2) the specific gallery URL and image numbers, and (3) a brief explanation. For copyright claims, include the information required under the DMCA. We will review and respond promptly.

12) Disclaimers & limitation of liability

  • As‑is. Galleries are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim implied warranties (merchantability, fitness, non‑infringement).

  • Service dependencies. Uptime, delivery speed, and features depend in part on Pixieset and your internet connection.

  • No consequential damages. To the fullest extent permitted, Booker Photo will not be liable for indirect, incidental, special, or consequential damages. Our total liability related to gallery access shall not exceed US$100.

13) Third‑party services

Galleries are hosted by Pixieset and may rely on content delivery networks, fonts, and analytics. Those third parties have their own terms and privacy policies.

14) Governing law & venue

These Terms are governed by the laws of the State of Oregon, without regard to conflict‑of‑laws rules. The exclusive venue for disputes that cannot be resolved informally is the state or federal courts in Multnomah County, Oregon. Small‑claims actions may be brought in a court of competent jurisdiction.

15) Changes to these Terms

We may update these Terms occasionally. The “Effective date” above reflects the latest version. Your continued use of the Galleries after changes means you accept the updated Terms.
